BANKRUPTCY

Why File For Bankruptcy?

Stop Foreclosure & Eviction

Work To Get Your Vehicle Back

Stop A Wage Garnishment

It has been said that you can stop foreclosure by filing for bankruptcy, but is that true? In most situations the answer is yes. When you file for bankruptcy you can suspend foreclosure proceedings, stop any harassment from the creditors and began to reorganize your finances while catching up with missed payments on your mortgage. At Clark & Washington, our Atlanta bankruptcy attorneys have extensive experience in helping Georgians save their homes through bankruptcy.

Once a car is repossessed, the financial effects can be devastating. Bankruptcy immediately begins to work for you by placing an automatic stay against all of your creditors. This prevents them from taking an action to collect debts. And continuing to hold your car is such an action. Once your bankruptcy attorney has offered the proper protections for the creditor (like proof of insurance and a repayment plan) you are on your way to getting your car back. It is not automatic or guaranteed, but you need to meet with your Bankruptcy Attorney to learn more.

In Georgia creditors can garnish up to 25 percent of every paycheck and take as much from your bank account as they deem necessary unless you act quickly to stop the garnishment from the beginning. Filing for bankruptcy is one of the most effective ways to put a stop to wage garnishment. The courts will issue an order that will stop any collection efforts against you and your property. Not only will you not have to stress about your money, the creditors will no longer be able to harass you through phone calls, collection letters or by trying to sue you or foreclose on your home.

BANKRUPTCY TYPES

The Difference Between Chapter 7 & Chapter 13 Bankruptcy

What is Chapter 7 Bankruptcy?

Chapter 7 bankruptcy, which is known as liquidation bankruptcy, involves selling some or all of your property to pay off your debts. This is often the choice if you don't own a home and have a limited income. Under Georgia law, some property and income is exempt from being sold off in Chapter 7 bankruptcy proceedings. The homestead exception can be critical to someone facing the prospect of foreclosure and eviction. There are also other exemptions under Chapter 7, but you should know that filing for bankruptcy has a long-term effect on your credit rating, for up to ten years. Anyone who tries to file for Chapter 7 alone risks omitting critical property exemptions or having their petition rejected altogether. You can avoid this by having an experienced bankruptcy lawyer guide you through the process.

What is Chapter 13 Bankruptcy?

Chapter 13 bankruptcy may be the best option to relieve your financial burden. The Atlanta bankruptcy lawyers at Clark & Washington recommends this type of filing for people with large amounts of debt that cannot be discharged through Chapter 7 bankruptcy. A Chapter 13 filing allows the bankruptcy court to set a schedule for repayment to creditors, usually during a period of three to five years.

Filing for Chapter 13 bankruptcy under federal law is known as debt consolidation or a debt repayment plan. In Chapter 13, as in other forms of bankruptcy, an automatic stay is issued once a petition is filed with a bankruptcy court. Creditors are barred from filing a lawsuit against you for money owed. And all collection processes, including harassing phone calls, must cease.
